- The revolutionary war was fought over a tea tax! The constitution was written, in part, so that the American people weren’t taxed into oblivion by a government that did nothing for them. Income taxes have always been introduced as “temporary” during depressions etc. they were never supposed to permanent, or even enforceable as per the constitution.
- The Pollock case gives the court’s opinion on income taxes prior to the 16th amendment, and the Brushaber case (Brushaber vs. UPRR 240 US 1) gives the court’s opinion after the 16th amendment. According to my understanding and recollection, Pollock ruled that an income tax on crops was unconstitutional because that was a tax on the land itself. The 16th amendment included the language, “from whatever source derived”, which allegedly made constitutional the tax on the crops, or the land. It is more complex than that, of course, but you need to read the Pollock and Brushaber cases together, at least, to understand the Court’s opinion on income taxes.

The Federal Income Tax is completely unconstitutional: In 1913, along with the Federal Reserve Act. the US Congress also pushed through Federal Income Tax; the 16th Amendment. Before that, income tax didn’t exist. However, under the Federal Reserve Act, the government would have to borrow money from the Federal Reserve with interest. In order to pay back this interest, governments would need to tax their citizens income. Hence, the 16th Amendment for Federal Income Tax. Surprisingly, however, the required number of States needed to ratify the amendment was never actually legally met. This has even been cited in modern court cases: “If you were to go back and try to find and review the ratification of the 16th Amendment… If you went back and examined that carefully, you would find that a sufficient number of States never ratified that amendment” – US District Court Judge James C. Fox (2003)
